Pollution Liability Insurance for Contractors 


Contractors involved in specialized services, such as demolition or road construction, are exposed to a variety of environmental exposures. ENCON's Pollution Liability insurance policy protects contractors against claims for third party bodily injury, third party property damage or third party environmental damage caused by pollution conditions resulting from the performance of their work.

Eligibility

The following provides an example of those eligible for pollution liability insurance:

  • General contractors
  • Subcontractors
  • Construction managers
  • Project owners, for owner-controlled insurance programs
  • Above ground and underground storage tank installers

A few examples of the types of projects covered by pollution liability insurance include:

  • Environmental remediation projects
  • Site restoration and cleanup projects
  • Abatement projects
  • Infrastructure and construction projects
  • Single or multiple site projects of most types
  • Brownfield projects
  • Land-based or marine projects

Coverage Details

  • Policy Form – The insurance is written on either an occurrence form or claims-made form
  • Policy Period – Annual policies; Multi-year policies (for specific projects) also available
  • Capacity – Limits up to $10,000,000 each incident/aggregate
  • Minimum deductible – $5,000
  • Minimum premiums –  $2,500 for a $1,000,000 limit, one-year term
  • Territory – Coverage for claims made in Canada

 

Policy Features

  • Coverage for sudden as well as gradual pollution conditions
  • $250,000 limit for Emergency Remediation Costs
  • Third party bodily injury, third party property damage and third party environmental damage caused by pollution conditions resulting from a contractor’s operations
  • Coverage for blanket or project-specific requirements
  • Coverage for pollution conditions resulting from completed operations
  • Protection against claims alleging improper supervision of subcontractors which results in pollution conditions
  • Supplementary Payments are included in the coverage agreement and do not reduce the limit of liability (certain conditions apply)
  • Incidental transit coverage included in the coverage agreement
  • Automatic extended reporting period of 30 days

Additional Coverages Available

  • Mould coverage is available on a claims-made basis
