Commercial General Liability (CGL) 


Businesses of all kinds face a number of liability exposures from incidents that may occur on their premises or as part of a non-professional aspect of their practice. ENCON’s Commercial General Liability (CGL) insurance provides protection against a range of potential claims that may result from bodily injury, property damage, personal injury or advertising injury.

Eligibility

This coverage is available to most classes of ENCON’s policyholders, as a complement to their professional liability or errors and omissions (E&O) insurance. This includes most classes for which ENCON underwrites errors and omissions insurance and whose liability predominantly relates to their professional services.

This coverage is furthermore offered to many classes of ENCON's non-profit directors and officers (D&O) policyholders that may not purchase E&O insurance. ENCON’s CGL target market within the non-profit sector is low to moderate risk exposures, so coverage is not being offered at this time to organizations with high CGL risk exposures, such as sports organizations, recreation facilities and youth organizations.

CGL insurance is offered on a monoline basis to eligible companies in the technology sector involved in the design, development, manufacturing or assembling of hardware products as part of ENCON’s Hardware Manufacturers liability insurance.

CGL insurance for eligible construction contractors is underwritten on a monoline basis in ENCON’s Construction Insurance department.

Coverage Details

  • Policy Form – The insurance is written on an occurrence-form
  • Policy Period – Concurrent with that of the firm’s professional liability or E&O policy
  • Capacity – Limits up to $25,000,000 with property damage deductibles starting at $500 (maximum limit available in Quebec is $20,000,000); Limits up to $5,000,000 are available for policyholders in ENCON’s Small Firm Programs for Architects and Engineers and the Information Technology sector
  • Annual minimum premiums – Starting at $495 for a $1,000,000 limit
  • Territory – Services anywhere in the world subject to suit first brought in Canada or the United States

Policy Features

  • Same pool of insurers who provide the professional liability or E&O insurance coverage; this reduces the risk that a gap in coverage may occur if two policies are placed with different insurers

  • Frequently requested coverage extension endorsements that are available include:
    • Non-owned automobile including S.E.F. 94, 96, 99
    • Employer’s liability (bodily injury)
    • Employee’s benefits errors and omissions
    • Tenants’ legal liability
    • Personal injury and advertising injury

Submission Requirements

Once we receive the application, the CGL business will be serviced by the same ENCON underwriter who handles the applicant’s professional liability or E&O policy.
